Terms and Conditions of Sale

  1. 1. General Provisions and Definitions These Terms and Conditions constitute a legally binding agreement between SIA "187" (hereinafter "We," "Us," or "the Company") and the customer (hereinafter "You"). By using this Website and placing an order, you agree to be bound by these terms.

    • 1.1. Definitions: "Residential-grade" refers to equipment intended for private household use. "Commercial-grade" refers to equipment specifically designed and marketed for business/industrial operations.

    2. 2. Product Classification and Intended Use

    • 2.1. System Categorization: Our catalogue distinguishes between Residential-grade and Commercial-grade water treatment systems.

    • 2.2. Misuse of Equipment: Residential-grade systems are strictly designed for household use. Installation or utilization of a Residential-grade system in any commercial, industrial, agricultural, or professional setting is strictly prohibited. Such misuse constitutes a material breach of these terms.

    • 2.3. Warranty Implications: If a Residential-grade system is used in a commercial environment, any and all warranties, expressed or implied, are immediately voided. We shall not be held liable for any system failure, production loss, or damages resulting from such unauthorized application.

    • 2.4. Commercial Agreements: Sales of Commercial-grade equipment are subject to individual specifications and may require a separate written agreement regarding installation and maintenance requirements.

    3. 3. Accuracy of Data

    • 3.1. Customer Responsibility: Our proposals for water treatment solutions are prepared based on the information and water analysis reports provided by you. You guarantee that any provided analysis is accurate, representative, and not older than 3 months.

    • 3.2. Performance Disclaimer: We are not liable for the performance of the system if the provided data (water analysis) was inaccurate, misinterpreted, or does not reflect the actual water quality at the point of installation.

    4. 4. Formation of Contract and Payments

    • 4.1. Order Process: Your order via the Website constitutes an offer to purchase. The contract is finalized only upon our electronic order confirmation and receipt of full payment.

    • 4.2. Pricing: All prices include VAT. We reserve the right to correct pricing errors.

    • 4.3. Payment Terms: All orders are processed on a prepayment basis. Bank transfer fees, if any, are to be covered by the buyer.

    5. 5. Shipping and Delivery

    • 5.1. Delivery Estimation: Stated delivery times (2–5 working days) are estimates. We are not liable for courier delays.

    • 5.2. Freight and Bulky Goods: Items exceeding standard parcel dimensions require a separate shipping quote, which will be provided upon review. The order is subject to your acceptance of these shipping terms.

    • 5.3. Transfer of Risk: Risk of loss or damage passes to you upon delivery (receipt of goods by you or your representative).

    6. 6. Right of Withdrawal (14-Day Policy)

    • 6.1. Return Eligibility: You have 14 days to withdraw from the contract.

    • 6.2. Non-Refundable Items: Items with broken factory seals, opened individual packaging, or products that have come into contact with water (filter cartridges, RO membranes, resins) are non-refundable for hygiene and safety reasons.

    • 6.3. Costs: Return shipping costs are the sole responsibility of the buyer.

    7. 7. Warranty and Service

    • 7.1. B2C vs. B2B: Private individuals (B2C) receive a 2-year warranty; legal entities (B2B) receive a 1-year warranty.

    • 7.2. Warranty Exclusions: The warranty does not cover consumables, wear and tear, or damage from improper installation.

    • 7.3. Maintenance: The warranty is valid only if the system is maintained according to the User Manual. Unauthorized changes to settings, failure to perform recommended filter replacements, or improper maintenance voids the warranty.

    • 7.4. Warranty Fulfillment: For B2C, we bear all reasonable shipping costs for warranty repairs. For B2B, the buyer bears shipping costs.

    • 7.5. Carry-in vs. On-site Service: Warranty repairs are performed on a "carry-in" basis at our facility. On-site service is an optional paid service (subject to a "Call-out Fee"), which covers technician travel and time. This fee is independent of the warranty repair cost.

    8. 8. Limitation of Liability

    • 8.1. Disclaimer: We are not liable for any damages resulting from improper installation by you or third parties. We strongly recommend professional certified installation.

    • 8.2. Cap on Liability: Our maximum total liability for any claim shall not exceed the amount paid for the product in question.

    9. 9. Intellectual Property and Privacy

    • 9.1. IP: All website content is the property of SIA "187".

    • 9.2. Data: We process your personal data in accordance with our Privacy Policy and GDPR.

    10. 10. Miscellaneous Clauses

    • 10.1. Force Majeure: We are not liable for performance failures due to events beyond our reasonable control (natural disasters, pandemics, strikes, transport disruptions).

    • 10.2. Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    • 10.3. Entire Agreement: These terms constitute the entire agreement between you and SIA "187" regarding the purchase of products.

    11. 11. Governing Law and Disputes

  11. 11.1. Jurisdiction: These terms are governed by the laws of the Republic of Latvia. Mandatory consumer protection laws of the Republic of Estonia apply to B2C transactions.
